Terms and Conditions – TheTCGPlug

Article 1 – Definitions

In these terms and conditions:

TheTCGPlug: the trading name of Amazian Handelsonderneming, based in Leeuwarden.

Trader: Amazian Handelsonderneming, trading as TheTCGPlug.

Consumer: any natural person acting outside their trade or profession who enters into an agreement with TheTCGPlug.

Business customer (B2B): any natural or legal person acting in the course of a trade or profession.

Agreement: any agreement concluded between TheTCGPlug and the customer concerning the sale of products.

Products: all items offered by TheTCGPlug, including but not limited to trading cards, booster packs, booster boxes, Elite Trainer Boxes, accessories, graded cards, singles, sleeves, displays and other TCG-related products.

Right of withdrawal: the consumer's statutory right to withdraw from the agreement without giving a reason within the statutory cooling-off period.

Business day: Monday to Friday, excluding recognised Dutch public holidays.

Article 3 – Applicability

  1. These terms and conditions apply to all offers, orders, agreements and deliveries by TheTCGPlug.
  2. By placing an order, the customer agrees to these terms and conditions.
  3. Any departures from these terms are valid only if confirmed in writing by TheTCGPlug.
  4. If one or more provisions of these terms are invalid or voidable, the remaining provisions remain in full force.
  5. In situations not covered by these terms, TheTCGPlug will decide in accordance with applicable Dutch law.

Article 4 – Offers

  1. All offers by TheTCGPlug are non-binding and subject to availability.
  2. Product photos are for illustration. A difference between the description and the product delivered does not affect statutory consumer rights, including withdrawal and the right to receive a conforming product.
  3. Obvious typing errors, pricing errors or other mistakes are not binding on TheTCGPlug.
  4. Products may temporarily sell out. If an ordered product is unavailable, the customer will be informed as soon as possible.
  5. TheTCGPlug reserves the right to change its range, prices and offers at any time.

Article 5 – Formation of the agreement

  1. An agreement is concluded when TheTCGPlug confirms an order.
  2. TheTCGPlug reserves the right to refuse an order in whole or in part, for example in the event of:
    • suspected fraud;
    • incorrect pricing;
    • payment problems;
    • limited product availability.
  3. If an order cannot be fulfilled, any amount already paid will be refunded as soon as possible.
  4. TheTCGPlug may request additional information before accepting an order.

Article 6 – Right of withdrawal

  1. Consumers have the statutory right to withdraw from an online purchase within fourteen (14) days of receipt without giving a reason.
  2. During this cooling-off period, the consumer must handle the product and its packaging carefully.
  3. The product may be unpacked only to the extent necessary to establish its nature, characteristics and functioning.
  4. The consumer must inform TheTCGPlug within the statutory period if they wish to exercise their right of withdrawal.
  5. After notifying TheTCGPlug of withdrawal, the product must be returned within fourteen days.
  6. Return shipping costs are borne by the consumer unless otherwise agreed or required by law.
  7. Business customers (B2B) do not have a statutory right of withdrawal.

Article 7 – Returns and exceptions

  1. After withdrawal, TheTCGPlug refunds the amount due within fourteen (14) days of receiving the withdrawal notice, using the original payment method unless otherwise agreed. TheTCGPlug may wait until the products have been received or the consumer proves that they have been sent back, whichever occurs first. For a full withdrawal, the cost of the cheapest standard delivery is also refunded.
  2. If a product is damaged through careless use or returned incomplete, TheTCGPlug may charge for the reduction in value.
  3. Exceptions to the statutory right of withdrawal apply only where permitted by law, for example goods made to the consumer’s specifications or sealed goods that cannot be returned for health or hygiene reasons once unsealed. Opening TCG packaging does not automatically exclude withdrawal; diminished value resulting from handling beyond what is necessary to inspect the product may be charged.
  4. Singles and graded cards have the same statutory withdrawal and conformity rights as other products.

Article 8 – Prices

  1. All website prices are stated in euros (€) and include VAT unless otherwise indicated.
  2. Any shipping costs are clearly displayed before the order is completed.
  3. Obvious pricing, typing or programming errors are not binding on TheTCGPlug.
  4. TheTCGPlug reserves the right to change prices. A price change does not affect orders already confirmed and paid for.

Article 9 – Warranty and conformity

  1. TheTCGPlug guarantees that products delivered conform to the agreement and to the customer's reasonable expectations.
  2. If a product is delivered damaged or incorrectly, the customer must report this by email as soon as possible, preferably within two months of discovering it.
  3. Any manufacturer's warranty does not affect the consumer's statutory rights.
  4. A warranty claim may be rejected to the extent that a defect is demonstrably caused by:
    • the product has been used incorrectly;
    • the product has been modified or repaired by third parties;
    • damage has resulted from negligence or misuse.

Article 10 – Delivery and shipping

  1. TheTCGPlug processes orders as quickly as possible.
  2. Stated delivery times are estimates and cannot be regarded as strict deadlines.
  3. If an order is delayed, the customer will be informed as soon as possible.
  4. If a product cannot be delivered, TheTCGPlug may terminate the agreement and refund the amount already paid.
  5. The risk of loss or damage to products passes to the customer once the order has been delivered to the specified delivery address or to a recipient designated by the customer.

Article 11 – Payment

  1. Payment must be made using one of the payment methods offered on the website.
  2. An order is processed only after payment has been successfully received, unless expressly agreed otherwise.
  3. If payment fails or is declined, TheTCGPlug reserves the right to cancel the order.
  4. Any refunds are made within the statutory time limits.

Article 12 – Complaints

  1. Complaints about products or performance of the agreement may be submitted to info@thetcgplug.nl.
  2. The complaint must include a clear description of the problem.
  3. TheTCGPlug aims to respond to complaints within fourteen (14) days of receipt.
  4. If a complaint requires more time, the customer will receive a message indicating the expected resolution time.

Article 13 – Disputes and applicable law

  1. All agreements between TheTCGPlug and the customer are governed exclusively by Dutch law.
  2. The parties will first attempt to resolve any disputes by mutual consultation.
  3. If the parties cannot reach a solution, the dispute will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
  4. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Article 14 – B2B terms

  1. Provisions concerning the statutory right of withdrawal apply only to consumers. Business customers cannot exercise that right.
  2. Orders placed in a business name or quoting a valid VAT number are treated as business orders.
  3. Returns from business customers are accepted only with prior written permission from TheTCGPlug.
  4. Complaints about damaged or missing products must be reported in writing within three (3) business days of receipt.
  5. TheTCGPlug reserves the right to cancel business orders in whole or in part if products are unavailable or an obvious error has occurred.

Article 15 – Force majeure, liability and retention of title

Force majeure

  1. TheTCGPlug is not liable for delays or failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to:
    • strikes;
    • transport problems;
    • supplier disruptions;
    • natural disasters;
    • government measures;
    • technical failures.
  2. If force majeure occurs, TheTCGPlug will inform the customer as soon as possible.

Liability

  1. TheTCGPlug’s statutory liability towards consumers remains in force.
  2. Any limitation of liability applies only to the extent permitted by law and does not restrict mandatory consumer rights.
  3. For business customers, liability for indirect loss is excluded to the extent permitted by law.
  4. Product characteristics such as centering and pull rates depend partly on the manufacturer. This does not affect statutory rights where a product is faulty or does not conform to the contract.

Retention of title

  1. All products delivered remain the property of TheTCGPlug until full payment has been received.
  2. Until payment has been made in full, products may not be pledged or provided to third parties as security.

Article 16 – Pre-orders, allocations and final provisions

Pre-orders

  1. Products offered for pre-order are delivered once officially available.
  2. Stated release dates are estimates and may be changed by the manufacturer or distributor.
  3. TheTCGPlug is not liable for delays caused by suppliers or manufacturers.
  4. If the supplier delivers fewer products than expected (allocation), TheTCGPlug reserves the right to adjust orders in whole or in part. In that case, the customer will receive a refund for the undelivered portion.
  5. If a pre-order cannot be delivered due to circumstances beyond TheTCGPlug's control, the amount paid will be refunded.

Order verification

  1. TheTCGPlug may contact the customer to verify an order before dispatch.
  2. An order may be cancelled if fraud or misuse is suspected.

Final provisions

  1. If any provision of these terms is invalid or unenforceable, the remaining provisions remain in full force.
  2. TheTCGPlug reserves the right to amend these terms and conditions. The latest version will be published on the website.
  3. These terms apply exclusively to all agreements, unless otherwise agreed in writing.
